confused about pioneers

So I had a large ring around my city from growth.  One of the AI factions was able to build a city inside my area of influence.  I am really confused about this.  I can't even step foot in an AI influence ring without them sending me warning messages about attacking me but they are able to build towns inside my ring?  That doesn't quite add up to me.

Did they have right of access?   Maybe pioneers are immune to those messages since they don't have combat strength?

I think they don't have an AI warning. If you don't have a non-agression pact you may be able to attack them without consequence.  (not sure). In other games, you can kill almost anything you want (outside of their territory) without risk of war. But it does tick them off a little each time.  Not sure what EWOM's AI logic on this is.  Otherwise, why have a non-aggression pact.
